1. Accounts

When you create an account with us, you must provide us with accurate, complete, and up-to-date information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password you use to access the Service and for any activities or actions undertaken under your password, whether in our Service or on a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Our Service allows you to transform YouTube videos into text articles through natural language processing technology. You understand and agree to the following regarding processed content:

• JourTube does not claim ownership of the original content of the processed YouTube videos.
• You are responsible for ensuring that you have the necessary rights to use the content you process through our service.
• The use of copyright-protected content without proper authorization may constitute copyright infringement.
• JourTube is not responsible for your use of the content generated through our Service.

By using our Service, you grant JourTube a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any medium or technology currently known or subsequently developed, for the sole purpose of enabling us to provide and improve the Service.

3. Limitations of Use

You agree not to use the Service to:

• Process illegal, fraudulent, deceptive, defamatory, obscene, pornographic content or content that violates the privacy or publicity rights of third parties.
• Infringe applicable laws, including intellectual property laws.
• Transmit or distribute malware, spyware, or any other malicious code.
• Interfere with the normal operation of the Service.
• Perform data scraping or use bots to access the Service.
• Collect personal information from other users without their consent.

JourTube reserves the right to suspend or terminate your account if, in our discretion, you have violated any of these restrictions.

4. Subscription Plans and Payments

The Service offers a free plan with limitations on the number of articles generated, as well as paid subscription plans with additional features.

When subscribing to a paid plan:

• You agree to pay the fees according to the terms established at the time of subscription.
• Payments are automatically charged at the beginning of each subscription period.
• Subscriptions automatically renew unless you cancel before the end of the current period.
• No refunds are offered for partial subscription periods.

JourTube reserves the right to change subscription fees with prior notice. Any change in fees will take effect at the beginning of the next billing period.

5. Service Availability and Modifications

JourTube strives to provide an uninterrupted service, but we cannot guarantee that the service will be available at all times. We may experience interruptions due to maintenance, updates, or factors beyond our control.

We reserve the right to modify or suspend, temporarily or permanently, the Service (or any part thereof) with or without prior notice. We will not be liable to you or to any third party for any modification, suspension, or interruption of the Service.

6. Limitation of Liability

In no event shall JourTube, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access or use or inability to access or use the Service.
• Any conduct or content of third parties on the Service.
• Content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

7. Disclaimer

Your use of the Service is at your own risk. The Service is provided "as is" and "as available". The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

JourTube does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements or expectations.

8. Indemnification

You agree to defend, indemnify, and hold harmless JourTube and its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: a) your use of and access to the Service; b) your violation of any of these Terms; c) your violation of any third-party rights, including without limitation any copyright, property, or privacy rights; or d) any claim that your content caused damage to a third party.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Argentina, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
